Nebeker Wills & Estate Settlements
John Nebeker -- died 1798
(son of the original Nebeker immigrant, Hans Nebeker, and father of our George Nebeker).
No will has been found for this man but the following brief record tells something of his circumstances when he died as a young man, leaving his widow, Mary Sennix Nebeker and his five children in 1798 in Newport, New Castle, Delaware. The information below was contributed by Dr. Peter Stebbins Craig.
“... On 14 Nov. 1787, John Nebeker of Christiana Hundred, yeoman, and his wife Mary conveyed to Joshua Todd a lot in Newport for L15. (New Castle deeds, G-2:165-166). From the proceeds for the division of John Sinnex’s farm at Middleburgh (John’s father-in-law). John and his wife were also entitled to one-twelfth of its appraised value, L563.17.6, or about L45 (there were 11 surviving children and, by law, the eldest son, Thomas Sinnex, was entitled to a double share.) Nevertheless, when he (John Nebeker) died in 1798, his estate was insolvent. On 12 March 1798, Peter Garritson, a Swede, was granted administration of the estate of John Nebecur of Christiana Hundred on proof that he was the principal creditor of the estate (New Castle County wills, O:326).
Peter Derickson found it necessary to sell at least part of John Nebeker’s remaining proerty in Newport to paya the bills of the estate. On 16 December 1800, the administrator filed a petition with the Orphan Court, stating that John Nebecar of Newport’s estate yielded L153.5.9 1/2 pls debts due to the estate of L63.2.6. However, the estate still had debts of L100 which remained unpaid. He was therefore authorized to sell the de eased’s “lots with a log house and slaughter house thereon. (NCOC--New Castle Orphan’s Court records J:51-53).
In the same year, John Nebeker’s widow Mary was listed as the head of his former household. She was then in the 26-44 years old age category (based upon the 1800 census). Five other persons (unnamed) shared her house:
One male, 26-44 (not identified; hired man?)
One female, 16-25 (not identified; hired man’s wife?)
Two boys and one girl, aged 0-9 (presumably her children).
John Nebeker’s widow, Mary, was still living in late 1816 when quite comprehensive tax records were colleccted for the year 1817. They showed the following (Karen M. Ackerman, Tax Assessments of New Castle County, Delaware, 1816-1817, 121.)
Hance Nebricar -- his person, 1 house and lot in Newport
Henry Nebeker estate -- 1 house and lot in Newport in the tenancy of F. Smith.
George Nebeker -- his person, 4 acre marsh, livestock
John Nebrichar -- 1 house and lot in Newport in tenancy of Mrs. Nebrichar.
It seems quite clear to me that Hance and Henry Nebricar were John Nebeker’s younger brothers and that George Nebrichar was a son of John Nebeker, deceased. The only other son shown among the records I have examined is Aquilla Nebeker, born 17, Jan. 1795 and baptized 20 Jan. 1799 at Holy Trinity Church. (Horace Burr, Records of Holy Trinity Church. p. 682.) No similar baptism record has been found for George Nebeker.
If John Nebeker and Maria Sinnex were married in 1782, as I have presumed, it is strange that there were no children aged 10-15 in widow Mary Nebeker’s household at the time of the 1800 census. It is possible, of course, that she had such children, but they were living in another household in 180 such as with one of their uncles (Henry or Hans).” {Or, such children may have died young.}

In the name of God Amen, I George Nebeker of the Town of Petersburg, being in my perfect senses mind and memory (Praised be God) do give & dispose of all my worldly goods in manner and form the following viz.
Imprimis, I give & bequeath unto my Mother Mariah Justice the sum of Fifty pounds current money of Virginia, to her own use & disposal-
Item. I give and bequeath unto my Nephew George Nebeker (son of my Brother John) the sum of two hundred pounds current money of Virginia & my gold watch to him his heirs & assigns forever-
Item. I give and bequeath unto my Sister Nancy Robertson the sum of Fifty pounds, current money of Virginia to her, her heirs & assigns forever-
Item. I give and bequeath unto my Brother Martin Nebeker the sum of Fifty pounds current money of Virginia to him his heirs &assigns forever-
Item. I give & bequeath unto my Brother Henry Nebeker the sum of One Hundred pounds current money of Virginia, to him, his heirs and assigns forever-

Item. I give & bequeath unto my Brother Lucas Nebeker One Hundred pounds Current money of Virginia to him, his heirs & assigns forever-
Item. I give & bequeath unto my sister Elizabeth Stedman the Sum of Fifty Pounds Current money of Virginia to her, her heirs & assigns forever.-
I give & bequeath unto my Brother Hance Nebeker the Sum of One Hundred pounds current money of Virginia, to him his heirs & assigns forever-

I give & bequeath unto the children of my late Sister Mary Springer the sum of one hundred pounds current money of Virginia, to be paid by my Executors into the hands of my Brother John Nebeker, & by him to be kept at Interest or any other way He may approve of, untill the youngest of said Children shall arrive to lawful age & then to be equally divided amongst them or their survivors, to them & each of them their Heirs & assigns forever-
Item. My will & desire is that my Negro Man Samuel be hence emancipated from slavery. I therefore leave him entirely free from all Servitude or claim of any person or persons whatever-
All the residue & remaining part of my Estate both real & personal, after all of my lawful Debts and funeral Expenses are paid I give & bequeath to be equally divided amongst all of my Brothers & Sisters now living namely John, Martin, Henry, William, Lucas & Hance Nebeker, Nancy Robertson & Elizabeth Stedman to them & each of them their heirs & assigns forever-

At a Quarter Session Court Continued & held for the Town of Petersburg at the courthouse of the said Town Tuesday the 8th day of August 1797-The last Will & Testament of George Nebeker dec’d was proved in open court by the oaths of William Colvin, James Williams & Wm Clarke three of the witnesses thereto & ordered to be recorded, And on the motion of Wm Nebeker one of the executors therein named who made oath together with James Williams his Security, entered into & acknowledged their Bond in the penalty of Two Thousand pounds, as the law directs, Certificate is granted him for obtaining a probate of the said will in due form, liberty being reserved for the other Executors named in the said will to join in the probate where they shall think fit.

In the name of God Amen- I Henry Nebeker of the Village of Newport County of Newcastle and State of Delaware being weak in body but of perfect mind and memory and considering the mortality of my body and that it is appointed once for all men to die and after that the judgement do make and ordain this my last will and testament in manner and form following. In the first place I will and desire that my legal debts and funeral expenses be paid out of what it hath pleased God to bless me with in this present world and secondly, I do will and bequeath unto Jonas Stidham’s oldest daughter Mary Stidham that part of my House that I now live in together with the one half of the Lott belonging to said house on the east side.
Thirdly, I do will and bequeath unto Jonas Stidham’s son John Stidham the other part of the house at present occupied by Widow Glachin? together with the remaining half of said Lott and to be by them enjoyed at my increase and all the endowments and …. of its arising therefrom.
Fourthly, It is my will and desire that Jonas Stidham may furnish me with what measures I may stand in need of for my present substance and to be defrayed out of my estate during my life.
Lastly it is my will and desire that Charles Anderson and Jacob Ball both of the County and State afore said be my lawful executors of this my last will and testament and I do hereby revoke, disavow and make void all former wills and testaments heretofore by me made. In witness whereof I set my hand this fourteenth day of September in the year of our Lord one thousand eight hundred and seventeen.
